  • Who is eligible to compete in the TraderSync Summer Cup? Anyone over age 18, an account with TraderSync, and a valid brokerage account they are the authorized owner of may join.
  • Where is the TraderSync Summer Cup available? We require you to register with your permanent address to ensure you are located where cash prizes are permitted. Individuals located outside of the United States of America and some states (AZ, AR, CT, DE, LA, MT, SC, SD, and TN) will not be eligible for cash prizes to comply  with local regulations.
  • What is the difference between skill-based gaming and gambling? Players’ abilities determine the outcome of a skill-based competition. Gambling involves significant elements of chance and increased performance is often uncorrelated with additional play.
  • What happens if players try to participate where cash competitions are not enabled? For states and countries where cash competitions are not permitted, generally, players may still compete for non-cash prizes.
  • How do I know this is a fair competition? TraderSync and Kernyl will audit all winners. For the cash prize,  competitors must have a brokerage account with TD Ameritrade that is synced with TraderSync. For the non-cash  prizes, each winner that does not have a TD Ameritrade brokerage account will be audited at the end of the  competition to ensure integrity.

TraderSync Summer Cup Contest Rules

NO PURCHASE NECESSARY FOR ENTRANTS CURRENTLY WITHOUT AN ACTIVE TRADERSYNC ACCOUNT (“Account”,  collectively “Accounts”). CURRENT SUBSCRIBERS WITH A TRADERSYNC ACCOUNT WILL BE GIVEN A TEMPORARY  UPGRADE TO THEIR CURRENT PLAN. SEE BELOW FOR FULL CONTEST DETAILS. PARTICIPATION IN THIS CONTEST  CONSTITUTES YOUR FULL AND UNCONDITIONAL ACCEPTANCE OF, AND AGREEMENT TO BE LEGALLY BOUND BY, THESE  CONTEST RULES (“Contest Rules”).

CONTEST PERIOD

  1. The Contest begins on Monday, July 12, 2021, at 9:30 a.m. Eastern Time (“ET”) and ends on Friday, August 13,  2021, at 4:00 p.m. ET (“Contest Period”)

ELIGIBILITY

  1. To be eligible to register for the Contest, you must: (a) be a natural person of the United States of America (the  “U.S.”) who is at least 18 years of age or older, and who is personally assigned to the email address submitted  during your registration; (b) have the power to enter into a contract with TraderSync; (c) be physically located  within a U.S. state in which participation in the Competition you select is unrestricted by that state’s laws; and (d)  at all times abide by these Terms. If any one of these requirements is not met at any time, TraderSync  (“TraderSync”, “Sponsor”, “we” or “us”), as organizers, may suspend or close your Account with or without notice.

HOW TO ENTER

  1. PURCHASE MAY BE NECESSARY IN CERTAIN SITUATIONS. To participate in this Contest you must:
    1. Have a valid TraderSync Account. If you do not currently have an active Account, you will be given a free trial for the Contest Period.
    2. Have a valid brokerage account with any broker that is supported by TraderSync available at www.tradersync.com/supported-broker/. For cash prizes, it is required that you have a brokerage account with TD Ameritrade (“TDA”) that is automatically synced to TraderSync.
      NOTE: THE ACCOUNT OWNER MUST ALSO BE THE PRIMARY OWNER OF THE BROKERAGE ACCOUNT YOU  ARE CONNECTING TO TRADERSYNC.
    3. Choose on the TraderSync dashboard which portfolio you will be using for the competition (“Contest Portfolio”, collectively “Contest Portfolios”).
    4. Comply with all TraderSync Terms and Conditions available at www.tradersync.com/terms-and-conditions/
    5. Have a valid Twitter account. If you do not have an Account, visit www.twitter.com and register in accordance with the enrollment instructions for a free Twitter account.
    6. Become a follower (“Follower”) of the official @TraderSync and @Kernyl_ channels (“Channels”). g. Connect you Twitter account to your Account with TraderSync.
  1. Your Contest Portfolio must comply with the following specifications (“Contest Portfolio Specifications”):
    1. Be a brokerage account that is solely owned by the Account owner;
    2. Only import trades from your brokerage account;
    3. Not be false, inaccurate, or misleading;
    4. Not violate and law or regulation; and
    5. Not contain any viruses or other interfering computer programming.
  2. BY ENTERING THE CONTEST, YOU ACKNOWLEDGE THAT YOUR ACCOUNT (INCLUDING YOUR USERNAME,  PROFILE PICTURE, AND PERCENTAGE RETURN) MAY BE POSTED ON TWITTER, FACEBOOK, OTHER FORMS OF  SOCIAL MEDIA AND/OR SPONSOR’S PROPRIETARY WEBSITE, WHERE IT MAY BE VIEWED, SHARED (BY USERS OF  TWITTER AND VARIOUS OTHER INTERNET-BASED SITES) AND COMMENTED ON BY THE SPONSOR AND  GENERAL PUBLIC.

WINNER SELECTION

  1. On Sunday, August 22, 2021, at approximately 10:00 a.m. ET, TraderSync and Kernyl will announce live at  www.twitch.tv/kernyl the winners of the Contest.
  1. Before being declared a winner: The winning entrants will be contacted by private message on Twitter and notified  that they are eligible to win. The winning entrants must reply by private message within one (1) business day of  notification and provide the Sponsor with an Account statement for audit, a phone number, and email. The  Sponsor will then email, and winning entrants will be required to sign and return within one (1) business day of  notification a declaration of eligibility and a liability/publicity release, which:
    1. Confirms compliance with the Contest Rules;
    2. Releases the Sponsor, its affiliated companies and agents, advertising and promotion agencies, the contest judges and each of their respective officers, directors, agents, representatives, successors and assigns from any liability in connection with the Contest, the entrant’s participation therein and/or the  awarding and use or misuse of the prize or any portion thereof; and
    3. Grants to the Sponsor the right to use the selected entrant’s name, address, and likeness in any form of advertising relating to the contest without further notice or compensation.
  2. If a winning entrant: (i) cannot be contacted by private message within one (1) calendar days of selection or there  is a return of any prior notification as undeliverable; or (ii) fails to return the contest documents within the  specified time, he/she will be disqualified and will forfeit the prize, and the Sponsor reserves the right to select an  alternate entrant from among the remaining eligible winning entries via the leaderboard.
  1. Winning entrants will be chosen from a digital leaderboard managed and maintained by the Sponsor.

PRIZES

  1. Grand Prize: There will be one (1) Grand Prize available to be won, consisting of one (1) cash prize of five hundred U.S. Dollars ($500 USD). The Grand Prize winner will be selected by the Contest Portfolio that is  connected to a TDA account with the largest per centum (%) return in the Contest Period.NOTE: The Grand Prize is a one-time only prize, and the winner must have a TDA Account that is connected  to the winner’s TraderSync Account and automatically synced.
  1. Big Ten Prize: There will be ten (10) Big Ten Prizes available to be won, consisting of one (1) Elite Membership  access to TraderSync for one (1) year. Winners will be selected by the top ten Contest Portfolios with the largest  per centum (%) return in the Contest Period.
  1. Most Active Journaler: There will be one (1) Most Active Journaler prize available to be won, consisting of one (1)  Elite Membership access to TraderSync for one (1) year. The Most Active Journaler winner will be selected by the  Contest Portfolio with the most amount of journal entries and tags (max 1 setup and 3 mistakes per trade) in the  Contest Period.
  1. Most Improved Trader: There will be one (1) Most Improved Trader prize available to be won, consisting of one (1) Elite Membership access to TraderSync for one (1) year. The Most Improved Trader winner will be selected by  the Contest Portfolio with the largest per centum (%) trade expectancy growth in the Contest Period.
  1. Comeback Kid: There will be one (1) Comeback Kid prize available to be won, consisting of one (1) Elite  Membership access to TraderSync for one (1) year. The Comeback Kid winner will be selected by the Contest  Portfolio with the largest per centum (%) drawdown to the amount gained back differential in the Contest Period.Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at  Sponsor’s option. Prizes will only be awarded to the person who is the owner of the Account.

GENERAL

  1. By entering the Contest, each entrant agrees to abide by these Contest Rules. This Contest is subject to all  applicable federal, state, and municipal laws. Void where prohibited by law. The decisions of the Sponsor with  respect to all aspects of this Contest are final and binding on all entrants without right of appeal.
  1. Sponsor reserves the right to cancel, suspend, withdraw, or amend this Contest in any way, without prior notice or  obligation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized  intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that  interferes with the proper conduct of this Contest as contemplated by these Contest Rules. Any attempt to  deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should  such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent  permitted by law, including criminal prosecution.
  1. You must warrant that your Contest Portfolio meets the Contest Portfolio Specifications. Sponsor reserves the  right to deem ineligible and exclude from the Contest any Contest Portfolio that Sponsor, in its sole and absolute  discretion, determines does not meet the Contest Portfolio Specifications. Your right to enter a Contest Portfolio  must not be restricted in any way. You must be able to provide legal releases for use of your Contest Portfolio by  Sponsor in any format, and materials related to the Contest, including in relation to any third party’s name,  likeness, or work (“Third Party Elements”) included with your Contest Portfolio.
  1. Sponsor’s right to use your Contest Portfolio: You acknowledge that your Contest Portfolio will immediately  appear on the Sponsor’s proprietary website and may appear in other electronic and print materials related to theContest, including promotional materials. By entering a Contest Portfolio using your Account, you irrevocably,  perpetually, and without limitation, grant Sponsor the right to use and publish your Contest Portfolio, in  commerce, and in any and all media worldwide in electronic and print materials related to the Contest, and waive  all your rights, including moral rights, in the Contest Portfolio, without notice or compensation, and agree you may be required to sign a release to that effect.
  1. All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and  absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including,  without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s  eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any  Contest Portfolio entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other  reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this  Contest in accordance with these Contest Rules. Failure to provide such proof to the satisfaction of the Sponsor in  a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole  determinant of the time for the purposes of a valid Contest Portfolio in this Contest will be the Contest server  machine(s).
  1. Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the  Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating  multiple Accounts, shall be deemed as tampering and may disqualify you from entering, participating, winning  prizes (defined herein), and preclude you from participating in future contests and promotions, at the sole  discretion of Sponsor. Entries that are late, lost, stolen, illegible, contain false information, are damaged,  misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy  any or all the conditions these Contest Rules will be judged void.
  1. Without limitation, the Sponsor, its advertising and promotion agencies and the Contest judges will not be liable  for any failure of the website during the Contest; for an technical malfunction or other problems relating to the  telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software;  for the failure of any Entry to be received by the Sponsor, its advertising and promotion agencies or the Contest  judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at  any website; or any combination of the above. Further, the Sponsor, its advertising and promotion agencies and  the Contest judges will not be liable for any injury or damage to an entrant’s or any other person’s computer  related to or resulting from participating or downloading any material in the Contest.
  1. In the event of a dispute, Contest Portfolios will be deemed to have submitted by the authorized account holder  of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is  assigned an email address by an internet provider, online service provider, or other organization (i.e., business,  educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the  submitted email address and is the owner of the brokerage account where the Contest Portfolio is derived from. If  the identity of an online entrant is disputed, the authorized account holder associated with the email account at  the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that  he/she is the authorized account holder of the email address associated with the selected Contest Portfolio. The  sole determinant of the time for the purposes of a valid Contest Portfolio in this Contest will be the Contest server  machine(s).
  1. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives,  storing, sharing and using the personal information submitted with his/her Account only for the purpose of  administering the Contest and in accordance with Sponsor’s Privacy Policy (available at: https://tradersync.com/privacy-policy/) unless the entrant otherwise agrees to receive further communications  from Sponsor. Your use of Twitter is subject to the Twitter Privacy Policy (available at: https://twitter.com/privacy).Your use of Twitch is subject to the Twitch Privacy Policy (available at: https://www.twitch.tv/p/en/legal/privacy-notice/).
  1. Contest is in no way sponsored, endorsed, or administered by, or in association with, Twitter, Twitch, or any entity  not described in these Contest Rules. Any questions regarding the Contest should be directed to the Sponsor or  Kernyl, not Twitch nor Twitch.
  1. In case any provision in these Contest Rules shall be invalidated, illegal, or unenforceable, the validity, legality, and  enforceability of the remaining provisions shall not in any way be affected or impaired thereby and such provision  shall be ineffective only to the extent of such invalidity, illegality, or unenforceability.

The  valuation of stocks and stock options may fluctuate, and, as a result, clients may lose more than their original  investment. The use of leverage can work against you, leading to large losses or can work for you, leading to large  gains.

    If the market moves against you, you may sustain a total loss greater than the amount you deposited into your  account. You are responsible for all the risks associated with this Contest. You should not engage in trading unless  you fully understand the nature of the transactions you are entering into and the extent of your exposure to loss. If you do not fully understand these risks, you must seek independent advice from your financial advisor.

    It is your responsibility to confirm and decide which trades to make. Trade only with risk capital; that is, trade with  money that, if lost, will not adversely impact your lifestyle and your ability to meet your financial obligations. Past  results are no indication of future performance. In no event should the content of this correspondence be  construed as an express or implied promise or guarantee.

The Sponsor, Kernyl, nor any affiliates, partners, directors, employees, or other third-parties of the Sponsor or The Next Stock are not responsible for any losses incurred because of competing in the Contest. By participating in  this Contest, you accept full responsibility of your trading gains and losses and indemnify TraderSync, Kernyl, and The Next Stock for decisions you make during the Contest.
